Age

We require any purchaser or acceptor of alcohol purchased to confirm they are aged 18 years or older. It is against the law to sell, supply or provide alcohol to a person under the age of 18 years. The customer also warrants that he/she is not under the influence of alcohol at the time the order is submitted or when the order is received.

Shipping methods

All orders require a signature upon delivery, and must be signed for by someone over the age of 18. Please address your order to an address where this can happen between the hours of 9am to 5pm (i.e Your Work address).  Delivery times can not be guaranteed. 

In general orders placed before noon will be processed same day.  Orders placed after noon will be processed the next business day.  You will receive your order in about 1 week after payment has cleared. Delivery times may be shorter for South Island and urban addresses, and longer for North Island and rural addresses. International order delivery times will be longer.  You will receive a tracking number by email when your order has been processed and ready to be picked up by the courier. Orders will not be processed or delivered on public holidays or weekends. 

We cannot guarantee​ that you will always receive your shipment within these timelines due to courier delays and other unforeseen complications, but will try our very best. Please allow for extra time during the busy holiday periods of November and December.

International orders

We can only ship orders to physical addresses (No PO Boxes or mail bags). If you are ordering from overseas, you must have the legal right to purchase alcohol in your current jurisdiction as well as the jurisdiction of delivery. International orders may be liable for extra taxes, duties, and/or fees.  These are the sole responsibility of the recipient and are not included in any price information provided by The Beer Library.

By making a purchase you must agree to the terms and conditions of the payment processor you choose to use.

Pricing

Prices, promotions and product availability are subject to change without notice. Prices listed on the website are for online purchases only and not valid in-store. All prices are in New Zealand Dollars.

Sales, Promotions, and Discounts

All sales, discounts, clearance items, and promotions are subject to availability.  Prices and availability may change at any time without notice.  There are no returns or exchanges on these items.  There are no rainchecks, layaway, or backorders allowed for these items.  All sales final.  Discount codes or coupons are not redeemable for cash.  Discount codes or coupons can not be used to purchase gift vouchers, advent calendars, subscriptions, events, or shipping insurance (or similar products) unless explicitly stated in the offer. Discount codes are for personal use only. We reserve the right to refuse discounts for particularly large and/or business orders at our sole discretion. Gift vouchers can not be used to purchase new gift vouchers.  Free shipping offers apply to domestic New Zealand shipping only.

The availability information presented on our Web site is the best, most up-to-date information we have, but errors do occur, and this information does not represent a guarantee or promise of availability.

Best By and Code Dates

Date codes and best by dates are set by the producers and represent the producer's best estimate as to the date at which the product will maintain an acceptable quality standard. Any best by or code dates listed on our website are taken directly from the products we have in stock and are accurate to the best of our ability, however you may on occasion receive product with a different date than indicated on our website. In the case of products that list a packaged on date, we generally assume the product will be good for at least one year after packaging and this is the date we will use for our best by estimates in most, but not all, of these instances. Not all products carry a best by date on the package and in this case we will not form a best by estimate for that product. If you have any questions about best by or code dates of our products, please contact us.

GST

Unless otherwise stated, all prices include New Zealand GST.

Changes and errors

We do our best to achieve 100% accuracy, but occasionally mistakes do occur. Pricing, product availability and offers subject to change without prior notification. We reserve the right to make changes without notice due to market conditions, manufacturer or supplier product discontinuation, or typographical, photographic or technical errors in online or print advertising. NOTE: Products and packaging depicted may differ from stock available at time of shipment; we reserve the right to substitute equivalent items.

Loyalty Programme

We reserve the right to remove, dishonour, change, or otherwise alter the amount of points in a member's balance at any time for any reason.  Generally this will be if we believe there has been fraudulent activity involved.

Our Guarantee

If for any reason you are not satisfied with our products or services then please email us clearly outlining the nature of your complaint or dissatisfaction. Any complaints will be handled quickly and efficiently and all information exchanged will be confidential.

General policy

We pride ourselves on our personal levels of service. If you are not delighted with your purchase then we are happy to offer an exchange or return the items to us within 14 days of receipt in its original condition and packaging and we will refund you the value less the delivery and recovery costs. Please note that the full, actual cost of postage for returns is the responsibility of the customer or purchaser and will be deducted from any refund issued. This may differ from the amount initially paid for shipping by the customer. Please email us prior to sending any back so we can issue a returns number.

If you make an order and wish to cancel your order due to a change of mind we will issue you a full refund less our credit card transaction fees of 3.5%

Orders returned to The Beer Library as undeliverable to the address supplied for any reason will be refunded, less actual costs incurred (this may include actual shipping costs, recovery costs, product loss costs, or any other costs incurred); or will be sent to the customer again at the customer's expense.

All Returns must be sent back via Trackable Courier Only.

Breakages

Unfortunately breakages occasionally happen in transit, in this instance please let us know immediately and we will refund in full your broken items. Refunds will be in the form of a gift voucher to the value of the broken product.

Mobile Message Service Terms and Conditions

The The Beer Library, Ltd mobile message service (the "Service") is operated by The Beer Library, Ltd (“ The Beer Library ”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Service provides updates, alerts, and information (e.g., order updates, account alerts, etc.) promotions, specials, and other marketing offers (e.g., cart reminders)] from The Beer Library via text messages through your wireless provider to the mobile number you provided. Message frequency varies. If you have subscribed to other The Beer Library mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number.  

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Privacy Policy

Collection of information: The Customer authorises The Beer Library to collect, retain and use personal information about the Customer for the purposes of:
​Assessing the Customer's credit-worthiness;
​Undertaking any dealings or transactions with the Customer;
​Enforcement of any legal or other rights The Beer Library may have against the Customer in any manner that The Beer Library sees fit;
​Making such disclosures as may in The Beer Library's opinion be required for any of the above purposes or generally to do business;
​Sending the Customer any advertising or promotional material; and
​Determining prize winners of promotions (if applicable).​

The Beer Library right to refuse application

If all of the requested Customer personal information is not supplied, or is not satisfactory to The Beer Library then his/her application for registration to The Beer Library may not be accepted.

Information retained by The Beer Library

The Customer agrees that any personal information supplied by the Customer will be retained by The Beer Library and will be accessible to The Beer Library employees and other persons or body corporate engaged by The Beer Library for or in relation to any of the purposes listed above. The Customers personal information will be held at The Beer Library (or at a cloud-hosting provider as The Beer Library's agent). The Beer Library shall retain all personal information supplied by the Customer until such time the Customer is deregistered. You may be contacted by email by a third party company regarding particular product or a service that you had received from us

Disclosure

The Customer authorises The Beer Library to disclose all or any part of any personal information provided by the Customer to a third party for any of the purposes listed above.

Customer rights

Under the Privacy Act 1993, the Customer has rights of access to his or her personal information held by The Beer Library and may request correction to that information. The Customer may do so by emailing info@thebeerlibrary.co.nz. The customer agrees to pay The Beer Library the reasonable charges requested by The Beer Library in relation to time and attendances involved in complying with the Customer's request in this regard.

Consent to receipt of electronic messages

The Customer consents to his or her inclusion in The Beer Library's direct marketing database and accepts that they may, as a result, receive electronic communications and promotional communications from The Beer Library. This website uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send cart reminder messages via SMS. The Customer has the right to ask The Beer Library at any time to stop sending online communications and promotional offers to them.

How do we protect your information?

We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information.

All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.

After a transaction, your private information will not be stored on our servers.

Do we disclose any information to outside parties?

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

Childrens Online Privacy Protection Act Compliance

We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.

Law and Jurisdiction

The Beer Library, Ltd., Company Number 5486683, Trading as The Beer Library, located at 78 Buchan St., Sydenham, Christchurch 8023, is the holder of a Liquor License 60/OFF/19/2016. Any sales of alcohol made via this internet site will be made on that liquor license. The applicable law for transactions for the purchase of alcohol on this internet site are the laws of New Zealand. The Laws of Sale and contract by any other country do not apply. By placing an order with www.thebeerlibrary.co.nz you accept that the ownership of the goods passes to the customer upon payment and dispatch of the goods from our warehouse. All product delivered to a New Zealand address will arrive to you Duty and GST Paid. You will not be liable for any additional charges. International shipments may incur extra costs by their local jurisdictions.

General terms and conditions

Terms, conditions and policies subject to change without notice. The Beer Library is not responsible for late or delayed shipments or system failures. The Beer Library retains title to items purchased until said items are paid for by the purchaser and at that time the title passes to purchaser. The terms of our agreements with some vendors represented in our online and print advertisements forbid us from exporting their products. All trademarks and registered trademarks are used to benefit and without intent to infringe on the holder of the mark. The Beer Library, The Beer Library logo and all other distinctive logos, marks and graphic elements are trademarks of The Beer Library Ltd. and are subject to applicable trademark protections. The Beer Library is not responsible under any legal theory for direct, special, incidental or consequential damages because of (i) delay in delivery, (ii) availability of products, (iii) personal injury arising from products purchased from us or (iv) failure of performance of any product purchased from us.
